with showers lingering throughout the morning hours. but as we zoom into the current time, currently dry. not raining but roads still slick along the peninsula and then we will head to parts of the east bay. look for light rain following along 580, 680 through the dublin interchange and into livermore, as well. also in the south bay, this is where we will see the showers continue through the morning hours until about lunch. so some rain throughout san jose and los gatos, and through morgan hill light rain. it's quickly tapering off. i'll tell you when it's going to clear in your neighborhood coming up in my next fast. temperatures in the upper 30s to mid-40s around 7:00. clearing this afternoon and then dry and cool this evening. katie. >> all right. thank you so much. all of the reservoirs and the water supplies are in good shape because of all of this. the san francisco public utility commission tells us it's

reservoirs are at 83% of capacity. east bay, five reservoirs, a combined 85%. and one of the santa clara valley water district's biggest rainwater reservoirs, the lexington, is at 63%. still room for rain down there. two people are dead of a getting washed into the water on the marin side of the golden gate bridge yesterday afternoon. a third person was able to make it back to shore and call 911. the coast barred and the tiburon fire department were not able to save a man and boy who were spotted in the water near the north tower of the golden gate bridge. sky 7hd was overhead as the rescue boats returned with both victims on board. their bodies were recovered just after five. they were pronounced dead when they arrived at a coast guard station. >> the unit shortly arrived within 25 minutes and recovered two bodies, one male adult and one child. those subjects were later pronounced deceased.

>> a high surf advisory was in effect at the time they got swept away. police mate an arrest in the case of a woman found bound and gagged on the san francisco street. the new person charged is 26-year-old katheryn wong, no one by her nickname "the killer." she and five other people stormed a house on december 9th, beat up a young man and woman and left them for dead on the street. the man did die, the woman survived. district attorney said the attacks maybe connected to a credit card fraud operation. investigators have not yet determined how a house fire in the astro district started last night. the fire broke out about 7:00 p.m. on 26th street near castro. most of the damage was done to the attic but a home next door also sustained some damage during the fire fight. no one was hurt. authorities are stepping up their efforts to keep drunk drivers off the road and they will keep up the added pressure

through new year's eve. tonight there are check points in san francisco, pacifica, redwood city, mountain view and san jose. abc7 news reporter alan wang reports from san rafael. >> around the bay area law enforcement agencies are conducting driver's license checks and, if needed, a sobriety test. >> do what you have to do but don't drink and drive. >> apparently an extra reminder is needed. during the week before christmas the chp made 1,171dui arrests statewide compared to 980 in 2011. fatalities were up more than double during this period. 39 compared to 14 last year. >> you know, i think people are a little more depressed this year. i think they are going out trying to find a relief for whatever pressures they have. >> i know a few. >> ben smith said he has friends who have had to pay the price for a dui arrest. >> it's expensive. i'm hearing different numbers. last time that i had a buddy,

like $6,000 or something like that. i've heard $10,000. >> businesses like the pier 15 restaurant and bar say they will call a cab or drive a customer home themselves. they say it's worth it for both patron and customer. >> that's why we have returning customers all the time because we do care about our customers. >> they are offering water in between drinks and saying do you have a ride home? >> and this through years eve, jessica said she's avoiding the drive all together. >> on new year's eve we are going to a house party and we are all sleeping, spending the night there. >> a local law firm will provide free cab service in san francisco on new year's eve and bart will provide extended service until 3:00 a.m. reporting in san rafael, allen wong, abc7 news. >> lots of resources out there. new this morning, same sex marriages are now legal in the state of maine. [applause] >> several city halls opened at 12:01 amidon to issue the

marriage licenses. the portland city hall was issuing them until 3:00 this morning. they cost $40 and require a valid photo id and a certified copy of a divorce decree if applicable. two other states have legalized marriage by popular vote, washington and maryland. there are fewer than three days left before taxes go up for almost all americans and several programs see major cuts. president obama met with republican and democratic leaders yesterday in a high stakes meeting at the white house. senate leaders will debate a new plan over the weekend, hoping to have a deal to vote on by monday. then it will go to the house. the president said a deal is critical for the nation. >> economists, business leaders all think we are poised to grow in 2013 as long as politics in washington don't get in the way of america's progress. so we've got to get this done.

demanding greater protection for women there. we are showing you the local effort to force change. >> it is just horrible. it's very, very sad. >> concerned bay area residents and members of local south asian organizations gathered in front of the the indian consulate in san francisco for a candlelight vigil in honor of the woman gaining raped in new delhi, india and died of her injuries. >> the extent of the violence is particularly shocking. >> on december 16th the 23-year-old gas gingrich raped and severally beaten while raiding this bus. six men were arrested in connection with the attack. the outrage has spread. >> it's growing alarming violence against women. >> she is the executive director of a bay area organization work to go end domestic violence in south asian communities. she helped organize the vigil to send a message to the indian consulate. >> this is not okay. >> she helped circulate a pegs

for improved security and safety for women in new delhi. >> they are equal members of society and have a right to public safety. >> the pegs was turned over to the consulate. in are you, they said they hope the woman's struggles and sacrifice would not go to vain. >> we hope this will be a turning point. >> that's exactly what they were hoping for. >> not something that will happen overnight but i guess education will help the process. >> now, the fbi looked at marilyn monroe as a potential communist. the bureau had been keeping tabs on monroe since 1956 when agents received an anonymous tip that money from her production company was going to the communist party. she was married at the time to arthur miller, who was a member of the communist parties.

the information does not contain new information on her death in 1962 or efforts by the bureau to investigate rumors that she had been murdered. >> new this morning the u.s. population is growing at a slower pace than projected. by new year's day it's projected to hit 315 million. that's an increase of less than 1% since the last census taken in april, 2010. low birth and immigration rates are given as the reason for the sluggish growth. a revised projection said the u.s. population will hit 400 million by 2015. that's short of the 439 million projected four years ago. move over prius. there's a new electric car in town that beats your gas mileage. the 2013 ford fusion will be certified by the epa as getting the electric equivalent of 108 miles a gallon in the city, 92 miles a gallon on the highway with a combined 100 miles to the gallon. the fusion's main rival, the

>> welcome back. we are coming up on 5:20 on saturday morning. you are looking live at the golden gate bridge. not many cars but you can see the pavement is wet. the rain has moved through the area, making its way south this morning. francis is joining us with a look at the forecast, exactly where and when it will continue to rain this morning. >> that's right. we had rain three hours ago on the golden gate bridge. we will take you outside and show you a live shot. the rain is starting to move south and it's quickly tapering, as well. here's a live look at interstate 80. we are picking up some returns right now over parts of the bay area. so let's go to live doppler 7hd and show you exactly where it's falling. during the last three hours you see the loop. look how quickly the green has disappeared, the light rain. then i will zoom in to the bay bridge. we have light returns over the bay bridge. it was on palo street, clearing

through that area. right now no rain falling over the golden gate bridge. in parts of the east bay look for some rain falling, as well, through parts of dublin and livermore and the pass on 580. and in the south bay right now looking clear on 101. possibly some light rain on parts of tully road and also 280 and basskin avenue. the showers are starting to taper off quickly. it's cool as well. in the 40s for the most part. 40 in antioch. we will see numbers drop down in the next hour, 6:00 is when we look at our coolest numbers. we will see if we can possibly squeeze out an upper 40. 44 san francisco and mountain view. the showers are tapering off. we will see clearing first in the north bay. snow levels in the hills dropping down to about 3,000 feet, and then with the clear conditions overnight, it is going to be very chilly into

tomorrow morning. but we will have a dry sunday. so here's a look at the satellite radar images. area of low pressure. this is continuing to slide south. as it does, the rain showers will move south, so that's why it's already clearing for us in the bay area. we should be clear by about noon. in fact, i ran the latest forecast models. so check out 7:00 already. only showing some showers in the santa cruz mountains. cloud cover for parts of the bay area, but already dry in the north bay. by lunchtime, dry for almost everyone with still some spotty showers, a chance of them continuing into the afternoon through the south bay and monterey bay. but then by 5:00 it's all gone. the system moves south bringing rain to southern california. there is still high surf advisory in effect until 10:00 tonight. current wave heights, 13 feet right now in bodega bay. do look out for strong rip currents and large waves.

>> welcome back, everyone. >> it is 5:30 and it is raining again in parts of the bay area this morning. we will start you off with the meteorologist francis in for lisa this morning. francis is tracking the storm. are where is the rain headed? >> it's headed south to be specific. here's a look at live doppler 7hdu see the center of the storm is moving now toward salinas as the area of low pressure, you see the rain circulate willing a counter clockwise direction. starting to clear in the north bay quickly and in the east bay you will find light rain on mission boulevard and fremont.

also the parkway. in the south bay that's where you will see the showers continue through the morning hours but it should be clear by lunchtime. some light returns being picked up. 101, 87 and 280. look for some light showers, as well, right now. light to moderate in parts of san martin, 101, all along gilroy and 152. so they are going to clear today, this afternoon. and this morning we are starting off with temperatures right now in the 40s. clearing this afternoon, climbing up to the low 50s. then by this evening it it wille cool and dry with temperatures in the low 40s to near 50 degrees. i'll have your full accuweather seven-day forecast coming up shortly. katie. >> thank you. continue our storm watch coverage this morning, keeping an eye on bay area reservoirs which have been filling up rapidly with all this rain. many are nearing capacity. abc news reporter kira klapper

is live. >> as soon as francis said the rain would be moving south, it started sprinkling a little bit. our drive down this morning was very wet on 101. a lot of slick conditions through redwood city and south of there. here in los gatos, as i said, not as wet as it has been. but it's been wet all over the bay area. let's take you to some video we have yesterday from marin county near mt. tam. it is full and overflowing. same for this dam. rushing water has been cass indicating over the top into alpine lake just below. reservoirs don't typically top off until april. you probably do know that. the marin municipal water district said all of their reservoirs, every one, has reached capacity this winter. that's the earliest in 30 years.

plans in case congress does not vote on a compromise to avoid the physical cliff. nearly every american's paycheck is about to shrink until they prevent the tax hikes from kicking in january 1st. president obama said he will propose another vote in case they don't vote on it. >> i will urge the senate to hold an up-or-down vote that protects the middle class from an income tax hikes and extends unemployment americans look for a job and lays progress for more economic growth and deficit reduction. i believe such a proposal could pass both houses with bipartisan majorities as long as these leaders allow it to come to a vote. >> republican house speaker john boehner said he's willing to bend on raising tax force the wealthiest americans to avoid the physical cliff. don't be surprised if you come across a dui checkpoint in your neighborhood over the next few days. the highway patrol and other law

enforcement agencies have their checkpoints in place. a bay area law maker is proposing a new solution for getting repeat drunk drivers off the roadways. it's already being as youd in other states. abc7 news reporter david louie has the details of the new proposal. >> the thinking behind the proposed crack down of repeat offenders is to address what state senator jerry hill says is a high rate of drunk drivers who don't modify their behavior. he cites twine statistics, the most recent numbers available. >> there were 161,000, 161,000dui arrests and convictions in california. twenty seven percent of those were repeat offenders. >> a second conviction would require a a driver to buy and install andre iguodala nation intercept device. this is video posted on youtube by several manufacturers showing how their devices work. a breath sample is taken and the

car will start only if the driver passes the test. a sobriety checkpoint helped to intercept drunk drivers and take them off the street. redwood city police officers have checked 15,000 vehicles so far this holiday period and made 18 arrests. they support senator hill's bill as an additional deterrent. >> the legislation that is being proposed today is actually needed to be added as part of the arsenal that we have in deterring people that may not just have the will or the dedication or the morale fortitude to not drive drunk. >> the ignition intercept device costs about $100 initially but requires ongoing calibration to ensure accuracy. that can run an additional 50 to $100 every two months. the two-time offender would have to use it for one year. three time offender would use it for two years, the four-time offender for three years. mothers against drunk drivers would prefer the proposed law be tougher. >> we prefer they be installed

on every dui-convicted persons car. in the meantime this legislation is a great stop gap. >> she said stop gap because four counties, including almeda county, are in the midst of a pilot project where they are required after a first conviction. and they are hoping data will come out of that project to bolt center their call for a stuffer law. abc7 news. an alert this morning from pg&e. the two utility is sending out tweets right now warning people a man with a hispanic accent is calling senior citizens telling them their service will be cut off unless they provide credit card or gift card information. pg&e said this is a scam. the utility would never ask for that kind of personal information over the phone and they want anyone who has been targeted to contact police. coming up next, need help with your new year's resolutions? well, there's an app for that. see what a bay area company has
